With the 2023 calendar year behind, there are a couple current items that Adult Care Facilities heard from the New York State Department of Health (DOH).
2023 ALP Minimum Wage Survey
The 2023 ALP Minimum Wage Survey was released on December 6, 2023, requesting Assisted Living Programs (ALPs) to complete and submit a survey to determine the financial impact of the minimum wage increases. Surveys were due by close of business Friday, December 29, 2023.
2022 ACF Annual Financial Report
On December 11, 2023, the DOH issued a Dear Administrator Letter (DAL) for the 2022 ACF Annual Financial Report.
Overview:
- Adult Care Facility’s (ACFs) whose current operator has been in operation for six months or more during calendar year 2022 as well as ACFs that underwent a change of operator between related ACFs during calendar year 2022, must submit the ACF Annual Financial Report on the Health Commerce System (HCS).
- If your ACF has 26 beds or more, a Certified Public Accountant (CPA) Certification must be completed and accompany the report submission. In order for this CPA certification to be completed for the 2022 ACF Annual Financial Report, a 2022 Audited Financial Statement must also be completed.
- Operator Certification is Required by all ACFs.
Deadlines:
- ACFs using calendar year (January 1 – December 31) as their fiscal year must complete the report by May 31, 2024.
- ACFs using a fiscal year period are required to file the report on the 15th day of the sixth calendar month following the close of their fiscal year. If this falls before May 31, 2024, then the due date is May 31, 2024.
6.5% Across the Board Investment
Also worth mentioning, as part of the New York State’s 2023-24 enacted budget, a 6.5% across the board Medicaid reimbursement rate increase was just recently paid to Assisted Living Programs on November 1, 2023, in Medicaid Cycle #2408. This increase is effective April 1, 2023 (revised rates can be found here).
